DEFINITIONS

The RUSSIAN DACHA BOUTIQUE is available at https://www.ruska-daca.si/butik/,and is operated by the Seller through the retail boutiques at the physical addresses, BU Zgornje Gameljne 18, 1211 Ljubljana – Šmartno and BU Kavčičeva 66, 1000 Ljubljana.

The SELLER is Ruska dača d.o.o., Škrjančevo 1, 1235 Radomlje. 1811673000, VAT ID No.: SI58688692

The CUSTOMER is any natural or legal person who makes a PURCHASE in the Russian Dacha Boutique.

A CONSUMER is a natural person who acquires goods or products, or uses a service for purposes outside his/her professional or gainful activity.

INTRODUCTORY PROVISIONS

These General Sales Conditions set out the conditions for visiting and shopping at the Russian Dacha Boutique, and the rights and obligations of the Seller and the Customer.

These General Sales Conditions may be supplemented or amended at any time without prior notice. The date is indicated on each version of the General Sales Conditions.

The text of the applicable General Sales Conditions is always accessible on the Website https://www.ruska-daca.si/butik/splosni-pogoji-prodaje.

DESCRIPTION OF THE BOUTIQUE

You can visit the Retail Boutique by appointment at BU Zgornje Gameljne 18, 1211 Ljubljana – Šmartno or BU Kavčičeva 66, 1000 Ljubljana, or every Saturday between 11:00 and 12:00 at BU Zgornje Gameljne 18, 1211 Ljubljana – Šmartno.

The Boutique website can be visited by anyone, except for the sections where alcoholic beverages are sold. Only people over the age of 18 can visit these parts of the website.

Any copying or modification of the Boutique, its parts or contents is prohibited.

The Boutique may also include links to third-party websites. The Seller is not responsible for the content and operation of third-party websites.

SHOPPING AT THE RUSSIAN DACHA BOUTIQUE

Through the Russian Dacha Boutique, the Customer can make an enquiry or express interest to purchase products other than alcoholic beverages. Only people over the age of 18 can purchase the latter.

The user can make an enquiry to purchase products 24 hours a day, 7 days a week.

All products in the Boutique are available while stocks last.

PRODUCT INFORMATION

Due to the nature of the business, the range of products is updated and changed frequently and promptly. The Seller endeavours to provide clear and complete information in order to present the basic characteristics of the sales products listed on the product packaging. The Seller recommends that the Customer reads the declaration or product information that came with the product before using the product.

Product information is for personal use only and may not be reproduced or otherwise used without the prior consent of the Seller. The Seller reserves the right to make substantive and other changes to product information in the Boutique without prior notice.

All product photos are for illustrative purposes only and do not guarantee the product features. The colour shades and images of the products shown in the photographs may differ from the actual product condition, which does not affect the product definition and standard. The Seller does not assume liability for any minimal discrepancies between the products and their representation on the Boutique website. The Seller is not responsible for textual errors in the product description texts; however, this does not affect the consumer’s legal rights.

PRODUCT PRICES

For each product, the price per unit or quantity of the product is indicated. The regular price is indicated for a product or group of products.

Product prices are in Euros and include VAT, any other charges, and the cost of preparing and shipping the order.

Prices do not include package delivery costs.

The prices of products in the Boutique may vary. The prices quoted at the time of the order confirmation by the Seller apply.

GIFT CERTIFICATES

Gift certificates are available for all services provided by Ruska dača d.o.o. This includes the services of the Villa, Boutique, Limousine, and Travel.

Gift certificates can have any value equal to or greater than €30. The value of the gift certificate includes VAT.

Gift certificates can generally be redeemed for any service (or multiple services at the same time) offered by the Seller.

Notwithstanding the terms and conditions set out in this section, the Seller may bind the certificate to a purchase of a particular product or service, or otherwise determine the conditions for redeeming the gift certificate.

All certificates are sold by the Seller in its own name and for its own account, only selling the certificate and not the products or services that the Customer can purchase from the Seller with the certificate.

The Customer may order, purchase, and collect the gift certificates as set out in these General Sales Conditions in the PLACING AN ORDER, PAYMENT METHODS, and ORDER COLLECTION sections.

Gift certificates are transferable. The Customer can redeem the gift certificate in such a way that, upon purchase, the Seller issues an invoice to the holder of the certificate with the value of the gift certificate deducted. Purchase with a gift certificate is only possible for the value printed on the gift certificate, or for any value that exceeds the value of the gift certificate which is agreed with the Seller. A gift certificate can in no case be exchanged for cash.

The gift certificate is valid for 1 (one) year from the date of issue, which is clearly indicated on the gift certificate.

PLACING AN ORDER

The Customer places an order following the steps listed below:

1. INTERESTED IN Form: The Customer sends an enquiry via the INTERESTED IN Form, over the telephone, or in person at a retail location.
2. CHOICE OF COLLECTION: The Customer selects a collection method, which can be one of the following:
– in-store pickup of the order, or
– delivery of products in Slovenia (delivery costs of €5 per order)
– when purchasing products in the value of over €100, delivery in the vicinity of Ljubljana (up to 25 km) is free of charge
3. SELECTION OF PAYMENT METHOD: The Customer selects a payment method which can be one of the following:
– payment on delivery (only cash payment is possible)
– advance payment (pro forma invoice)
– payment on pickup at a retail location (credit or debit card payment possible, or cash)

ORDER/PURCHASE REJECTION

The Seller may, with justified reasons, reject the order or purchase of the products, in particular in the following cases:
– a significant error has been detected in the description or price of the product;
– payment authorisation has not been executed by the bank;
– if the consumer abuses the right to return the products in accordance with consumer protection legislation;
– if the Seller receives a credit or debit card abuse notification from a bank or government agency, or has been ordered to reject or revoke the order by a government authority for other reasons in accordance with their jurisdiction,
– if, at the time of delivery of the alcoholic beverages ordered, the Seller finds that the Customer or the person who accepts the order is not over 18 years of age, shows obvious signs of alcohol intoxication, or is reasonably suspected to supply the alcoholic beverages to persons under 18 years of age.

The Seller processes the confirmed orders in the order of confirmation of orders, or according to the planned dates for collection of the order or home delivery. The Seller processes the orders as soon as possible, but within a maximum of 3 (three) working days after confirming the order.

PAYMENT METHODS

The following payment methods are available to the Customer:

  1. Advance payment (via pro forma invoice) – The Seller issues a pro forma invoice to the Customer, which the Customer settles to the account specified on the pro forma invoice. The Customer receives an invoice upon delivery or collection of the goods.
    2. Payment on delivery – Payment is only possible in cash. The Customer receives an invoice upon payment.
    3. Payment directly at the retail location upon collection of the goods. Payment is possible in cash or with the following credit or debit cards: MasterCard, Visa, Maestro, Karanta, and Diners.

If the Customer has liquidity issues upon collection, the delivery service or the employee does not hand over the product at the collection point, but cancels the order and indicates that it is a non-collected order.

ORDER COLLECTION and NON-COLLECTED ORDERS

The Customer can collect the ordered products in two ways:

IN-STORE PICKUP

For in-store pickup, the Customer may collect the order by prior arrangement at BU Zgornje Gameljne 18, 1211 Ljubljana – Šmartno or BU Kavčičeva 66, 1000 Ljubljana or every Saturday between 11:00 and 12:00 at BU Zgornje Gameljne 18, 1211 Ljubljana – Šmartno.

After the expiry of the 3rd day from the date set for in-store pickup, the order can no longer be collected, and the order is cancelled and marked as a non-collected order. The amount already paid for non-collected products will be returned to the Customer, to the account from which the order was paid.

HOME DELIVERY

The Seller at this time provides delivery only in the territory of the Republic of Slovenia.

The Seller provides home delivery in the territory of the Republic of Slovenia, in cooperation with a contractual partner. The cost of the delivery of products in Slovenia is €5 per order.
When purchasing products with a total value exceeding €100, delivery in the Ljubljana area (up to 25 km) is free of charge.

With refrigerated products (caviar), only in-store pickup or delivery in Ljubljana and its vicinity (distance up to 25 km) is possible.

In the event that the Customer does not collect the order at the time specified for home delivery, the Seller or the delivery service will send the Customer a message about the options for collecting the order. If the Customer does not collect the order within the time specified for collection, the delivery service returns the order to the Seller. After that, the order can no longer be collected, and the order is cancelled and labelled as a non-collected order. The amount already paid for non-collected products will be returned to the Customer, to the account from which the order was paid, less the cost of delivery. In subsequent purchases, but for no longer than 1 year, the Customer cannot select the option of home delivery in the Boutique.

COMPLAINTS AND DISPUTES

Visitors and customers can send their objections, complaints, and other comments in writing by email to butik@ruska-daca.si or by regular post to: Ruska dača d.o.o., Škrjančevo 1, 1235 Radomlje.

The complaint procedure is confidential. The Seller shall use its best endeavours to settle any disputes amicably. If this is not possible, the dispute shall be settled by the court of competent jurisdiction in Ljubljana.

PROTECTION OF PERSONAL DATA AND PRIVACY

The Data Controller is the Seller – Ruska dača d.o.o., Škrjančevo 1, 1235 Radomlje.

Information about the processing of personal data is published and always accessible on the Seller’s website at https://www.ruska-daca.si/politika-zasebnosti. The published information on the processing of personal data is regularly updated by the Seller.

Rights of data subjects: Access to data, rectification, portability, and to a limited extent, erasure, restriction of processing, and objection. The rights can be exercised through a written application sent to the Controller’s address or by email to butik@ruska-daca.si.

If you feel that we are not exercising your rights properly, you may file a complaint or report to the Information Commissioner of the Republic of Slovenia (more information can be found at https://www.ip-rs.si).

IF YOU ORDERED THE DELIVERY OF PRODUCTS FROM THE BOUTIQUE:

When submitting your enquiry for products from the Boutique, please provide us with your first and last name, email address, and telephone number. This information is intended to address your enquiry and prepare a quote. If you order the products, we will ask you to provide us with a possible shipping address, and we will also process payment information for the products. Unless you subscribed to the newsletter, we will only use your email address for the purpose of communicating with you regarding your enquiry and order. The information required for delivery (first and last name, address, and telephone number) will be forwarded to the selected delivery service for the purpose of delivery. We will keep your purchase information for 5 years from the time the order is executed, and for tax purposes for 10 years from the date of invoice.
